Oklahoma Court of Civil Appeals

Division I

120,902 – In the Matter of R.J.T., Alleged Deprived Child, Chris Elliott, Appellant, v. State of Oklahoma.  Appellee. Appeal from the District Court of Tulsa County, Oklahoma.  Honorable Julie Doss, Trial Judge. Appellant Chris Elliott (Father) appeals from an order terminating his parental rights as to minor child R.J.T.  Father argues that his due process rights were violated in the failure to timely provide an adjudication hearing and because he was unable to be present at the termination hearing in person, and that the Appellee State of Oklahoma failed to present sufficient evidence to sustain a termination of parental rights pursuant to 10A O.S. § 1-4-904 (B) (12).  We affirm. Opinion by SWINTON, J.; GOREE, P.J., and DOWNING, J., concur. Aug. 3, 2023

120,977 – Gary Gunn, Petitioner/Appellant, v. Multiple Injury Trust Fund and The Workers’ Compensation Commission, Proceeding to review an order of the Workers’ Compensation Commission. Petitioner/Appellant Gary Gunn seeks review of an order of the Workers’ Compensation Commission which affirmed an ALJ’s order denying Gunn’s claim against the Multiple Injury Trust Fund for permanent total disability.  The Commission’s order is not clearly erroneous in view of the substantial competent evidence or contrary to law and we therefore sustain it.  Opinion by SWINTON, J.; GOREE, J., and DOWNING, J., concur. Aug. 3, 2023

Division II

120,962 – Gator, LLC, an Oklahoma limited liability company, and Gator Roustabout, LLC, an Oklahoma limited liability company, Plaintiffs/Appellees, v. Jason Clark, Defendant/Appellant.  Appeal from the District Court of Logan County, Hon. Louis Duel, Trial Judge.  Defendant Jason Clark appeals from the district court’s Journal Entry Granting in Part and Denying in Part Plaintiffs’ Application for Temporary Restraining Order and Temporary Injunction.  Mr. Clark has generally failed to supply any analysis, legal authority, or record citations in support of his assertions on appeal, and we conclude no error has been demonstrated in the Journal Entry from which he appeals.  Therefore, we affirm.  AFFIRMED.  Opinion from Court of Civil Appeals, Division II, by BARNES, V.C.J.; WISEMAN, P.J., concurs, and HIXON, J., concurs specially. 120,522 – Donald M. Selvidge, Petitioner/Appellee, vs. Travis J. Ingram, Respondent/Appellant.  Appeal from the District Court of Caddo County, Hon. David A. Stephens, Trial Judge.  Travis John Ingram appeals a final order of protection entered against him for domestic abuse and/or stalking.  After review, we conclude the trial court erred in entering the order because the Petitioner, Donald M. Selvidge, did not allege or demonstrate an intimate or familial relationship with Ingram that would support a protective order for domestic abuse nor did he support his claim of stalking.  The protective order was granted without support in the record and against the clear weight of the evidence.  The decision is reversed and the order of protection is vacated.  REVERSED AND VACATED.  Opinion from Court of Civil Appeals, Division II, by WISEMAN, P.J.; BARNES, V.C.J., and HIXON, J., concur. Aug. 8, 2023

We find the trial court did not err in sustaining the revocation of Achziger’s driver’s license. AFFIRMED.
