Oklahoma Court of Civil Appeals

Division I

Division II

122,182 – Virginia Campbell, Plaintiff/Appellant, vs. Sadler Investments, LLC, Defendant/Appellee.  Proceeding to review an Order of the District Court of Comanche County, Hon. Scott Meaders, Trial Judge.  Plaintiff Virginia Campbell, a commercial tenant operating a restaurant in a shopping center, brought this suit against her landlord, Defendant Sadler Investments, LLC, the shopping center owner.  Plaintiff sought damages for injuries she sustained when she slipped and fell on ice and snow that had accumulated in the parking lot and on the sidewalk in front of her restaurant.  Plaintiff appeals from the district court’s order granting summary judgment in favor of Defendant.  The condition that caused Plaintiff to slip and fall was an open, obvious, and natural accumulation of ice and snow that resulted from a week-long winter storm.  Therefore, Defendant had no duty to protect Plaintiff from or warn her of that condition.  We find no error in the district court’s determination that Defendant was entitled to judgment as a matter of law.  AFFIRMED.  Opinion from Court of Civil Appeals, Division II by FISCHER, J.; HIXON, C.J., and WISEMAN, P.J., concur. Division III

Division IV

121,722 – Mark Farris and JoLana Farris, Husband and Wife, Petitioners/Appellants, vs. Oklahoma Water Resources Board, Respondent/Appellee, and Preston W. Masquelier and Candy Masquelier, Husband and Wife, Intervenors/Appellees.  Appeal from the District Court of Oklahoma County, Hon. Don Andrews, Trial Judge.  Petitioners/appellants, Mark and JoLana Farris (collectively, Petitioners), appeal a district court order finding that Petitioners were not entitled to any relief as requested and that the court lacked subject matter jurisdiction over the action.  On review, we find that the district court erred in dismissing this action for lack of subject matter jurisdiction, and remand it to the district court, so that it may conduct a judicial review of the Oklahoma Water Resources Board’s decision in accordance with Oklahoma’s Administrative Procedures Act.  REVERSED AND REMANDED FOR FURTHER PROCEEDINGS.  Opinion from Court of Civil Appeals, Division IV, by HUBER, J.; BARNES, P.J., and HIXON, V.C.J., concur.
