Oklahoma Court of Civil Appeals

Division I

Division II

120,738 (Comp. to Case No. 120,739) – In the Matter of the Adoption of: R.G.S. and C.E.S., Minor Children. Dillon Lucas Macias, Appellant, v. Trey Smillie, Appellee. Appeal from the District Court of Canadian County, Hon. Bob W. Hughey, Trial Judge. Dillon Lucas Macias appeals a trial court order denying his motion for new trial in this adoption case. We must determine whether the trial court abused its discretion in denying that motion. After review of the appellate record and applicable law, we find no error or abuse of discretion in the trial court’s denial of the motion for new trial, and we affirm the trial court’s order. AFFIRMED. Opinion from Court of Civil Appeals, Division II, by WISEMAN, P.J.; BARNES, V.C.J., and HIXON, J., concur. July 12, 2023

120,739 (Comp. to Case No. 120,738) – In the Matter of the Adoption of R.G.S. and C.E.S., Minor Children, Dillon Lucas Macias, Appellant, v. Trey Smillie, Appellee. Appeal from the District Court of Canadian County, Hon. Bob W. Hughey, Trial Judge. Dillon Lucas Macias appeals a trial court order denying his petition to adopt RGS and CES without the consent of their natural father, Trey Smillie. The issue is whether the trial court correctly concluded Macias failed to show by clear and convincing evidence that a statutory ground exists for allowing RGS and CES to be adopted without Father’s consent. The trial court concluded that Macias failed to show by clear and convincing evidence that Father’s consent was not needed for adoption of the minor children. After review, we see no trial court error in its decision to deny his petition, and we affirm. AFFIRMED. Opinion from Court of Civil Appeals, Division II, by WISEMAN, P.J.; BARNES, V.C.J., and HIXON, J., concur. July 12, 2023
