Oklahoma Court of Civil Appeals

Division II

118,714 – Mitch Palmer, an individual, Plaintiff/Appellant, vs. Steve Bertram, an individual, Defendant/Appellee.  Appeal from an Order of the District Court of Lincoln County, Hon. Cynthia Ferrell Ashwood, Trial Judge.  Plaintiff, Mitch Palmer, appeals a Final Journal Entry of Judgment, entered after a jury verdict, finding in favor of defendant, Steve Bertram, and against Palmer in this action for trespass.  Upon thorough review of the record, this Court concludes the evidence presented at trial supported the jury’s verdict.  Nor does this Court find any prejudicial or fundamental error in the jury instructions.  Based on the foregoing, this Court finds the trial court did not err in entering its Final Journal Entry of Judgment, entered after a jury verdict, finding in favor of defendant, Steve Bertram, and against plaintiff, Mitch Palmer, in this action for trespass.  The trial court’s Final Journal Entry of Judgment is affirmed.  AFFIRMED.  Opinion from Court of Civil Appeals, Division II, RAPP, J.; WISEMAN, P.J., and BLACKWELL, J., concur.
