122,095 – Alameda Square Plaza, LLC, Plaintiff/Appellee, vs. Green Bee Meds, LLC, Defendant/ Appellant. Appeal from the District Court of Oklahoma County, Hon. Don Andrews, Trial Judge. Appellant Green Bee Meds, LLC (Green Bee) appeals an order granting summary judgment against it in favor of Alameda Square Plaza, LLC (Alameda) for breach of a commercial lease, and an order denying Green Bee’s Motion to Vacate. The trial court entered summary judgment against Green Bee after it failed to respond to Alameda’s Motion for Summary Judgment. Green Bee then moved to vacate, arguing it received no notice of the Motion, and that summary judgment was improper. On review of the record, the briefing and applicable law, we find that Alameda was not entitled to summary judgment on the record presented, notwithstanding Green Bee’s failure to respond and dispute material facts. We reverse the trial court’s summary judgment and denial of the motion to vacate and remand for further proceedings consistent with this opinion. REVERSED AND REMANDED FOR FURTHER PROCEEDINGS. 122,973 — In the Matter of the Adoption of K.N.L., Keia Beaver, Appellant, vs. Robert Lee Littlejohn and Michelle Littlejohn, Appellees. Appeal from the District Court of Ottawa County, Hon. Matt R. Whalen, Trial Judge. Keia Beaver (Mother) is the biological mother of K.N.L., a minor. The paternal grandparents have served as the guardians to the minor child since 2019 and filed for adoption without the parent’s consent on October 26, 2022, while Mother was incarcerated. The trial court held two evidentiary hearings on the petition, issuing its Findings of Fact and Conclusions of Law finding that the adoption without consent could proceed on grounds that Mother failed to establish and/or maintain a substantial and positive relationship with the minor for twelve (12) consecutive months out of the last fourteen (14) months immediately preceding the filing of the petition. Mother filed a Motion to Reconsider which the district court heard and denied. Mother now appeals the trial court’s Order Denying Motion to Reconsider filed of record in the underlying case. After careful review of the record and applicable law, we find no abuse of discretion, thus the Order Denying Motion to Reconsider is affirmed in its entirety. AFFIRMED. 122,077 – In the Marriage of: S.W.A., Jr., Petitioner/Appellee, vs. N.L.A., Respondent/Appellant. Proceeding to review an Order of the District Court of Sequoyah County, Hon. Kyle E. Waters, Associate District Judge. Norma L. Armstrong appeals a trial court order granting her divorce from Sinclair W. Armstrong, Jr. Ms. Armstrong alleges it was error for the court to bifurcate the proceedings, grant the divorce, and reserve all remaining issues such as property division, debt division, support alimony, and discovery issues. Upon review, we find that the court did not abuse its discretion and thereby affirm. AFFIRMED. Joe Crosthwait, Jr.; and Andrea Mertens, Respondents/Appellees. Appeal from the District Court of Oklahoma County, Hon. R. Trent Pipes, Trial Judge. Patricia Bowers Edwards, mother of Robert Drew Bowers, an incapacitated person, appeals an order from the district court awarding attorney’s fees and costs to McAlister, McAlister, Baker, and Nicklas, PLLP (McAlister Firm). Based on our review of the briefs, appellate record, and applicable law, we affirm the district court’s December 13, 2023, order awarding attorney’s fees and costs to the McAlister Firm. AFFIRMED. 122,010 — Corde Brown, Plaintiff/Appellee, vs. State of Oklahoma ex rel. Oklahoma Department of Human Services, Defendant/Appellant. Appeal from the District Court of Tulsa County, Hon. Daman Cantrell, Trial Judge. The Oklahoma Department of Human Services appeals from the district court’s Order reversing an Administrative Law Judge’s decision to place Corde Brown on the community services worker registry for neglect of a vulnerable adult. Based on the failure to present an appellate record suitable for appellate review, we affirm the district court’s Order. AFFIRMED.
