Oklahoma Court of Civil Appeals

Division I

124,148 – In the Matter of J.L.K., alleged to be a deprived child as defined by the laws of the state of Oklahoma, Whitefish Lake First Nation, #128, Appellant, v. State of Oklahoma, Appellee. Appeal from the District Court of Payne County, Oklahoma. Honorable Bryan  Plank. Appellant is an indigenous First Nation of Canada, but it is not a federally recognized tribe of the United States.  Appellant sought to intervene as a party in a juvenile proceeding even though ICWA does not apply.  Appellant has voluntarily submitted to the jurisdiction of the court and seeks to advocate its perspective of the best interests of a child adjudicated as deprived.  Because it has established all criteria for intervention by right under 12 O.S. §2024(A)(2), the order is REVERSED. Opinion by GOREE, J.; SWINTON, P.J., and BELL, J., concur. Oct. 28, 2026

123,943 – In the Matter of: K.N.-C., Alleged Deprived Child, Brittany Crawford, Appellant, v. State of Oklahoma, Appellee. Appeal from the District Court of Oklahoma county, Oklahoma. Honorable Nichole M. Gillett, Trial Judge. Appellant Brittany Crawford (Mother) appeals from an order terminating her parental rights to minor child K.N.-C.  Mother argues that the order was not supported by clear and convincing evidence, that she was denied procedural due process, and that she was deprived of effective assistance of counsel.  We affirm. Opinion by SWINTON, P.J.; BELL, J., and GOREE, J., concur. Oct. 29, 2026

123,181 – Lyndee Rose Porter, Appellant, v. Scott Christopher Adams and Lisa Garriott Adams, Appellees. Appeal from the District Court of Tulsa County, Oklahoma. Honorable Kurt G. Glassco, Trial Judge. Natural Mother (Appellant), Lyndee Porter, seeks review of the July 25, 2025 Tulsa County District Court order which found the best interests of her children, L.V.P. and E.R.P., were served by allowing the adoption proceeding to continue and recommended adoption of the children by Guardians, Scott and Lisa Adams (Appellees). The adoption proceeding was properly before the district court and the court’s decision to allow the adoption proceeding to continue is supported by clear and convincing evidence. AFFIRMED.  Opinion by GOREE, J.; SWINTON, P.J., and BELL, J., concur. Nov. 2, 2026

Division II

Division III

123,733 – In re the Marriage of: Edward M. Blau, Petitioner/Appellee, v. Courtney C. Blau, Respondent/Appellant. Appeal from the District Court of Oklahoma County, Oklahoma. Honorable Jennifer Selling Montagna, Trial Judge. Appellant, Courtney C. Blau (Mother) and Appellee, Edward M. Blau (Father) share joint custody of their minor children pursuant to a Consent Decree of Dissolution of Marriage. Father filed a Motion for Enforcement of Visitation Rights. Over Mother’s objection, the trial court sustained the motion. Thereafter, Father filed a Motion for Attorney Fees and Costs. The trial court sustained the motion with two reductions. It is from these orders Mother appeals. After a thorough review of the record and the applicable law, we find the trial court did not err in enforcing the parties agreed custody plan, but did err in awarding attorney fees. Therefore, we AFFIRM the Journal Entry and Order (Enforcement Order) enforcing the parties agreed custody plan and REVERSE trial court’s Journal Entry and Order (Fees Order) awarding Father attorney fees. Opinion by DOWNING, P.J.; SWINTON, J. (sitting by designation), and GOREE, J. (sitting by designation), concur. Oct. 30, 2026

123,991 – In the Matter of: T.J., Alleged Deprived Child, Bernard Neely, Appellant, v. State of Oklahoma, Appellee. Appeal from the District Court of Oklahoma County, Oklahoma. Honorable Kaitlyn G. Allen, Trial Judge. Bernard Neely (Neely) appeals the underlying Order terminating his parental rights of his child, T.J., following a jury trial.  Neely contends on appeal that (1) the State failed to satisfy ICWA’s heightened “active efforts” standard with clear and convincing evidence; (2) the trial court committed fundamental error in its jury instructions concerning the qualifications of the State’s expert witness under 25 C.F.R. § 23.122; and (3) the State failed to prove beyond a reasonable doubt, through qualified expert testimony, that continued custody would result in serious emotional or physical damage to T.J.  Based on our review, we find the record supports the trial court’s finding that DHS made active but unsuccessful “active efforts” to reunify Neely with T.J.; that the State’s expert was qualified to testify; and that the State proved beyond a reasonable doubt that Neely’s continued custody would result in serious emotional or physical damage to the child.  We, accordingly, AFFIRM. Opinion by PRINCE, V.C.J.; DOWNING, P.J., and MITCHELL, J., concur. Oct. 30, 2026

124,347 – The Icon at Norman Apartments Limited Partnership, Plaintiff/Appellee, v. Douglas Warr, Cleveland County Assessor, and Cleveland County Board of Tax Roll Corrections, Defendants/Appellants. Appeal from the District Court of Cleveland County, Oklahoma. Honorable Jeff Virgin, Trial Judge. Appellants, Douglas Warr (Warr) and the Cleveland County Board of Tax Roll Corrections (BTRC) (collectively Appellants) appeal from the trial court’s July 23, 2026 Order granting summary judgment in favor of The Icon at Norman Apartments Limited Partnership (Icon) and ordering Appellants to correct the 2024 tax roll. Based on our review of the record and applicable law, we AFFIRM pursuant to OKLAHOMA SUPREME COURT RULE 1.202(a), 12 O.S.2021, Ch. 15, App. 1. Opinion by DOWNING, P.J.; PRINCE, V.C.J., and MITCHELL, J., concur. Oct. 30, 2026

Division IV

123,411 – EnviroDispose, LLC, an Oklahoma limited liability company, Plaintiff/Counter-Defendant/Appellant, v. Boomer Environmental, LLC, an Oklahoma limited liability company, and Jason J. Martin, an individual, Defendants/Counterclaimants/Third-Party Plaintiffs/Appellees, v. Dustin B. Watson, an individual, Third-Party Defendant/Appellant, and DBW Consulting, Inc., an Oklahoma corporation, and Dustin B. Watson, LLC, an Oklahoma limited liability company, Third-Party Defendants.  Appeal from the District Court of Oklahoma County, Hon. C. Brent Dishman, Trial Judge.  Pursuant to 20 O.S. 2021 § 30.1, which gives this Court “jurisdiction to issue writs of . . . mandamus . . . or any other process when this may be necessary in any case assigned to it by the Supreme Court,” this Cause is hereby recast as a request for extraordinary relief.  See BS&B Safety Sys., L.L.C. v. Edgerton, 2023 OK 89, ¶ 1, 535 P.3d 1283, 1283.  A writ of mandamus is issued directing the assigned judge in Case No. CJ-2025-723, District Court of Oklahoma County, to, within 30 days after issuance of mandate, conduct a hearing on the motion to dismiss pursuant to the Oklahoma Citizens Participation Act (OCPA), 12 O.S. 2021 §§ 1430-1440, filed by Appellants.  We vacate the trial court’s Order filed in September 2025, denying the OCPA motion and determining that “[t]he rehearing scheduled on that motion for August 21, 2025 is STRICKEN.”  APPEAL RECAST AS REQUEST FOR EXTRAORDINARY RELIEF; WRIT OF MANDAMUS ISSUED; ORDER OF THE DISTRICT COURT VACATED WITH DIRECTIONS.  Memorandum Opinion from Court of Civil Appeals, Division IV, by BARNES, J.; BLACKWELL, P.J., and HUBER, J., concur. Oct. 28, 2026

122,986 – Brushworx Paint & Dry Wall, LLC, Plaintiff/Appellant, v. Vesta Realty, LLC, a foreign limited liability corporation, and Wedgewood Apartments Acquisition, LLC, a foreign limited liability corporation not registered to do business in the State of Oklahoma, Defendants/Appellees.  Appeal from the District Court of Oklahoma County, Hon. Anthony L. Bonner, Trial Judge.  Plaintiff appeals from the trial court’s judgment enforcing a settlement that a member of Plaintiff negotiated directly with Defendant Vesta Realty, LLC (Vesta).  The judgment also dismissed this action with prejudice and denied the motion of Plaintiff’s counsel to enforce an attorney lien against Vesta and Defendant Wedgewood Apartments Acquisition, LLC.  We express no view on the merits of the trial court’s rulings or on any claim between Plaintiff and its counsel under their fee agreement.  Because Plaintiff has acquiesced in the judgment’s enforcement of its settlement and is not aggrieved by the other rulings it challenges, and because the only person aggrieved by any of those rulings has not appealed, the appeal is dismissed pursuant to Okla. Sup. Ct. R. 1.6(c)(1), 12 O.S. 2021 & Supp. 2026, ch. 15, app. 1.  APPEAL DISMISSED.  Memorandum Opinion from Court of Civil Appeals, Division IV, by BARNES, J.; BLACKWELL, P.J., and HUBER, J., concur. Nov. 2, 2026

123,418 – Khine Zune Zune Harris, Petitioner/Appellee, vs. Keith Harris, Jr., Respondent/Appellant.  Appeal from the District Court of Comanche County, Hon. Grant Sheperd, Trial Judge.  Keith Harris, Jr. (Father) appeals a district court Journal Entry terminating joint custody and awarding custody of one minor child to Khine Zune Zune Harris (Mother) and one minor child to Father.  Father also appeals a district court order granting Mother’s request to relocate out-of-state.  Father has not shown the district court erred.  Based on our review of the sparse record and applicable law, we affirm the district court’s Journal Entry filed on August 13, 2025, and the court’s decision granting Mother’s request to relocate.  AFFIRMED.  Opinion from Court of Civil Appeals, Division IV, by HUBER, J.; BLACKWELL, P.J., and BARNES, J., concur. Nov. 3, 2026
